Jabalpur: EWS candidates have received a major setback from the High Court in Jabalpur, Madhya Pradesh. Chief Justice Suresh Kumar Kate and Justice Vivek Jane’s couple refused to provide EWS (economically weak) candidates like the other reserve category class, and refused to provide an exemption of 9 ATAMPT number in UPSC. The Jabalpur High Court has ordered EWS to reject all such petitions.
The Jabalpur High Court Beach has stated in its order that the problems of the backward classes and the economically backward classes are different. Therefore, candidates for the EWS category cannot provide ease with age. It has also been said that there is no arrangement in the constitution to exempt the AWS class candidates.

They had filed an application

In the 16 petitions filed, including Aditya Narayan Pandey, a resident of Satna, it was said that the EW candidates were kept in a safe category. Despite being in a safe category, EWS candidates are not provided with other age limit. UPSC has determined the age limit and the number of eighteen for the EWS category in the initial examination of the year 2025. While waivers have been provided to other parts that are kept in a safe category.

EWS candidates demanded

It was said by the applicants that by providing reservation on an economic basis, the OBC class is also eased in the age limit. In addition, the issue of providing 9 ATAMPT to the candidates in the state government’s OBC class list was also included in the petition.

UPSC and DOPT have no rule

Earlier, the High Court had allowed the EWS class to fill the UPSC form by relaxing age. During the hearing of the petition, the DOPT guideline was presented by UPSC. Even in its rules, there is no such delivery to give the EWS class to the age limit. However, in the High Court, the EWS class was instructed to allow the form to fill the form in the past. The couple issued instructions to preserve the decision after the hearing on February 24.

The couple, in their order, cited the 103rd amendment of the Indian Constitution, saying that separate classes have been set under Articles 15 and 16. Economically weak and socially and academically backward classes are different. Civil Article 16 (4) have different classes EWS and SC, ST and OBC. Which is not normal. The High Court also acknowledged that the benefits of the Central and the state government may vary in the reservation case. The OBC list is different at the center. At the same time, a separate list of population -based OBCs has been made in the state. Because of this, the benefits received by the Center cannot be challenged.

OBCS won’t get 9 ATMS in UPSC

The couple has refused to provide 9 ATMPT relief to the OBC class candidates on the state list. The couple quoted Article 342-A as saying that the central list means a list of OBCs produced by the central government. Reservation and exemptions and privileges for other backward classes in central and state lists are under the provisions of Articles 15 and 16 of the Constitution. Special caste or community informed in the central list can provide reservation and benefits to services under the central government.
