The Congress has written a letter to the Assembly Speaker asking that action be taken against MLA Nirmala Spray under the Anti-Defection Act and her membership in the Assembly be revoked. Congress also issued three notices to Nirmala Spray, but she did not give a clear reply to any of the notices. After the assembly speaker received a complaint from the Congress, Nirmala Spray had said that I have not left the Congress. In such a situation, it is now believed that a decision can be taken about their membership and meeting arrangements on the first day of the winter session i.e. December 16.
Worked against Congress in Lok Sabha elections.
During the Lok Sabha elections, Bina MLA Nirmala Spray had switched sides and sided with the BJP. He worked against the Congress Lok Sabha candidate Chandra Bhushan Singh (Gado Raja) Bundela. The Congress candidate also faced a crushing defeat from the Bena Assembly. MLAs then openly became part of the BJP’s membership drive. Nirmala Spray is seen with local BJP leaders and workers.

A photo of BJP has also been posted on the social media account of Bina MLA Nirmala Spray. On his official Facebook account, only the BJP logo and his DP and BJP flags and banners are visible in the background. Photographs of PM Narendra Modi, CM Dr Mohan Yadav and BJP state presidents are being put up at their posts and posters at festivals and events.
The Congress will take the matter to the High Court.
State Congress President Jitu Patwari and Leader of Opposition Umang Singhar have expressed their clear opinion about the Bina MLA spray. Singhar had recently said that BJP does not believe in democratic system. He also said that we have no illusions about Nirmala Spray. Their membership is to be decided by the Speaker of the Assembly.
