The court said in its ruling that former presidents would be protected from prosecution for actions taken under their constitutional authority, not in their personal capacity.

The United States Supreme Court has held for the first time that former presidents are immune from prosecution for certain actions taken while in office, as it overruled a ruling by justices rejecting Donald Trump's bid to shield himself from criminal charges linked to his efforts to overturn his 2020 election defeat.

The court ruled 6-3 on Monday that former presidents are immune for actions taken under their constitutional authority but not for actions taken in their private capacity.

The decision marks the first time since the nation’s 18th-century founding that the Supreme Court has said former presidents can be protected from criminal charges in any case.

Chief Justice John Roberts delivered the landmark decision on behalf of the Court's six-judge conservative majority. The Court's three liberal justices dissented.
