Trump’s decision was challenged in court, after which the judge declared it unconstitutional and imposed a temporary establishment on the order. On this, Trump said his administration would appeal against the judge’s decision.

Trump’s decision spread chaos in Indians

According to the US State Department, Indians get the highest visa in the United States by issuing L-1 work visas. 72 % of the total H-1B visa issued by the United States are Indians.

There are both L-1 and H-1B temporary work visas that allow foreigners to temporarily operate in the United States. The foreigners living in the United States on the work visa are the most Indian, and Trump’s decision is the most troubled.

In view of this, women who are pregnant on work visas and are in the seventh or eighth month of pregnancy, are delivered to the baby by premature parts.

Pregnant couples want to give birth to a baby before the deadline so that their baby gets US citizenship and the child’s citizenship is easy.

According to US law, if one is born in the United States, it gets birth citizenship. However, it does not get parents citizenship, yes, they certainly make it easier to get citizenship. Parents can apply for US citizenship through a child. But with Trump’s decision, children born to immigrant parents will be denied US citizenship after February 19.

Where will the children born after February 19?

After Trump’s decision, there is a question in people’s minds, if the children of Indians born in the United States do not get American citizenship, then where will they be considered a citizen?

He said, “Under the current US law, children born in the United States are given the right to birthright without taking into account the status of their parents’ migration. However, this will not happen after the new principle. Those children will not get a birthright on a temporary visa like Parents H-1B, H-4 or students. A lot has changed.

He added, ‘This means that parents of parents living on temporary visas will not receive US citizenship from February 19, 2025. Instead of getting citizenship, they have to apply for citizenship as a parent or in other ways.

Indian citizenship process for children born in Indian parents

Persian expert Ahmed says it is easy for these Americans to gain Indian citizenship.

He says, ‘As far as Indian citizenship is concerned, Indian nationality is usually found on the basis of parents’ nationality. If both parents are an Indian citizen, then their child will also be considered an Indian citizen, even if he was born in the United States (provided the parents voluntarily abandon their Indian citizenship or such actions. Do not voluntarily be taken away. The child will be considered an Indian citizen on a family basis.

But in some rare cases, parents have to register the birth of a child with the authorities concerned for the child’s Indian citizenship. This will have to be made for the citizenship of a child born before February 19 in the United States.

“If the child is born before a change in the new principle and is an American citizen since birth, he cannot be given Indian citizenship until the parents apply for it, and gain Indian,” says expert Ahmed. Children will have to abandon US citizenship (because India does not allow dual citizenship).
