According to Swati Deshpande’s report, the Sessions Court upheld the sentence of a person who sent a message around midnight to a married woman, with an image, which the complainant said that she was vulgar. The court said that in messages “you are slim”, “You are looking very smart”, “You are fair”, “I am 40 years old”, “Are you married or not?” and I like you”.
Finding no error in the decision of the convict by a magistrate in 2022, Additional Sessions Judge DG Dhobal said, “Pornography should be judged from the point of view of an average person applying contemporary community standards”. The sessions court said that the woman was a corporator and her husband a former corporator.
“Any married woman or her husband, who are iconic and a corporator, raise such WhatsApp and pornographic photos, which are sent to her cell from 11 am to 12.30 pm when there is no relationship with the sender, “The Sessions Court said. The court upheld a three -month -old imprisonment and a fine of Rs 1,000 imposed on the convict. The magistrate directed that the victim be given compensation of Rs 3,000. The alleged victim’s phone was not confiscated, the eligibility was not found in the defense of the accused.
The court said, “No woman would put her dignity at stake by accused the accused in a false case,” the court said and admitted the oral evidence of obtaining a porn image.
